We Challenge the Government in Hanoi to Response the Letter From President of Radio Free Asia 

Below is the letter (*1) from the president of Radio Free Asia, Ms. Libby Liu, was sent to the Hanoi People's Court requires the unconditional release of Doctor of Law Cu Huy Ha Vu, because the arrest had violated the Article 19 of the Universal Declaration of Human Rights and also the Article 19 of the International Covenant on Civil and Political Rights:

Dear Officers of the Hanoi City People's Court: 

We at Radio Free Asia, are writing to express our deep concern about the arrest and indictment of attorney Cu Huy Ha Vu and to call for his immediate release. 

We understand Mr. Ha Vu has been accused of "propaganda against the Socialist Republic of Vietnam" in accordance with Article 88 of the Vietnamese Criminal Code; and that the charge stems in good part from the fact that he participated in interview with Radio Free Asia. 

Mr. Ha Vu's right to speak to Radio Free Asia (or anyone else for that matter) and express his opinions on any subject is unmistakably protected by Article 19 of the U. N. Declaration of Human Rights. 

Article 19 states:

"Everyone has the right to freedom of opinion and expression: this right includes freedom to hold opinions without interference and to seek, receive, and impart information and ideas through any media, and regardless of frontiers." 

Additionally, Mr. Ha Vu's rights are explicitly laid out in the International Covenant on Civil and Political Rights the Socialist Republic of Vietnam has been a party to since 1982. Prosecuting him for exercising this universal human right is itself a violation of the international law. 

We urge that Mr. Ha Vu be released immediately, the charges against him dropped, and Mr. Ha Vu be allowed to express himself without further interference.

We challenge Hanoi government to response to this letter from Ms. Libby Liu because Hanoi government has never complied with the international laws.  The international laws must be naturally ranked higher than the national laws.  On July 18, 1977, Socialist Republic of Vietnam joined The United Nations, of course SRV authorities must recognize and commit to follow the values of the Universal Declaration of Human Rights (1948) when becoming a member of The United Nations.  Next, on September 24, 1982, SRV again signed the International Covenant On Civil Rights And Politics (1966). In summary, the government of SRV must comply with these two international laws.  All national laws must be changed to adapt suitably to international laws, not against them. 

 

More than one month ago, according to Reuteur's news, when answering the press about the incident of political deputy Christian Marchant, the spokeswoman of the Vietnamese Ministry of Foreign Affairs Nguyen Phuong Nga said: " foreign diplomats also have a responsibility to abide by the host country's laws."  This answer caused many articles to criticize her that she did not understand the international laws must be ranked higher than the country's laws.  Learning about that, she later mentioned the Vienna Convention, but still stubbornly use the word "respect" instead of the previous word "abide" to the laws of Vietnam, as we saw in the article in ThanhNien Newspaper (*2).

 

The authorities of SRV would rather not sign to join the United Nations; or else, when signing, they must abide by the international rules.  They usually show stubborn voice: "Human Rights in Vietnam are different from any country due to the differences in culture and history", meanwhile the value of human rights is universal.  Many times, they usually say: "People can't take the law of this country to impose upon other country."  In fact, their voice is only half true because they have forgotten the general universality of human rights.

An Employee of The US Embassy Causing Disturbances

Yesterday 1/6, ThanhNien Newspaper informed that the authorities of Thua-Thien, Hue province is reviewing cases related to acts of disturbing public order of a diplomatic agent of the US Embassy, in Hue.

Earlier in the morning of 1/5, many people on Phan Dinh Phung street, Hue city saw a foreign man, carrying a suitcase in hand and claiming that he is a diplomat of the US Embassy in Hanoi shouting in English and Vietnamese with some very obscene words. This has made many people curious to stand and watch. An employee of Foreign Affairs of Thua-Thien, Hue, gently comforted him but this foreign man aggressively talked he was an diplomat he could   go anywhere, could meet anyone without a permission. He then pushed the employee fall to the ground, and then he punched in the face of a civilian standing nearby, pushing a number of people were watching, this made many people angry and suspected this guy might be impersonating rather than a diplomatic agent who can not act like that. But soon afterward, police presented in time and invited this foreigner said above to the Department of Foreign Affairs of Thua-Thien, Hue to work. (in Vietnam, work means investigate)

Depending on the ThanhNien's source, in the Department of Foreign Affairs of Thua-Thien, Hue, the foreign man produced card which certified him a diplomat named Christian Marchant, political officer of the U.S. Embassy in Hanoi. Foreign Affairs officials explained the US laws but Mr. Marchant has proved with an uncooperative attitude, then leaved voluntarily.

In yesterday afternoon of 1/6, answering questions about this incident to the press, Ms. Nguyen Phuong Nga - Vietnamese Foreign Ministry spokesman said: "Vietnam always makes conditions for diplomatic commissioners and the foreign diplomatic operation in Vietnam in accordance with the provisions of international law, including the Vienna Convention on diplomatic relations in 1961. Meanwhile, diplomatic commissioners and foreign diplomats are also obliged to comply with the Vienna Convention and respect the laws of host countries."

Một nhân viên Đại sứ quán Mỹ gây rối trật tự

Hôm qua 6.1, nguồn tin Thanh Niên cho biết, cơ quan chức năng tỉnh Thừa Thiên -Huế đang xem xét vụ việc có liên quan đến hành vi gây rối trật tự công cộng của một viên chức ngoại giao của Đại sứ quán Mỹ tại Huế.

Trước đó vào sáng 5.1, nhiều người dân chứng kiến trên đường Phan Đình Phùng, TP Huế có một người đàn ông ngoại quốc, tay xách cặp tự xưng là nhân viên ngoại giao tòa Đại sứ Mỹ tại Hà Nội quát tháo ầm ĩ bằng cả tiếng Mỹ và tiếng Việt với một số người VN bằng những ngôn từ rất tục tĩu. Sự việc này đã khiến nhiều người tò mò đứng lại xem. Một nhân viên Sở Ngoại vụ tỉnh Thừa Thiên - Huế đã nhẹ nhàng khuyên giải nhưng người đàn ông ngoại quốc vẫn hùng hổ nói ông ta là nhân viên ngoại giao có thể đi bất cứ đâu, gặp bất cứ ai mà không cần phải xin phép. Tiếp đó, ông này còn gạt người nhân viên ngã dúi dụi, sau đó đấm vào mặt một người dân đứng gần đó, xô đẩy cả một số người đang đứng xem, khiến nhiều người dân phẫn nộ và nghi ngờ đây hẳn là mạo danh chứ một viên chức ngoại giao không thể hành xử như vậy. Tuy nhiên ngay sau đó, công an đã kịp thời có mặt và mời người nước ngoài nói trên về Sở Ngoại vụ tỉnh Thừa Thiên - Huế làm việc.

Theo nguồn tin Thanh Niên, tại Sở Ngoại vụ Thừa Thiên - Huế, người đàn ông ngoại quốc xuất trình thẻ chứng nhận nhân viên ngoại giao là Christian Marchant, viên chức chính trị Đại sứ quán Mỹ tại Hà Nội. Các cán bộ ngoại vụ giải thích các quy định pháp luật VN nhưng ông Marchant vẫn tỏ thái độ bất hợp tác, sau đó tự ý bỏ về.

Trong chiều hôm qua 6.1, trả lời câu hỏi bình luận về sự việc này của báo chí, bà Nguyễn Phương Nga - người phát ngôn Bộ Ngoại giao VN nói: VN luôn  tạo điều kiện cho các cơ quan đại diện ngoại giao và các nhà ngoại giao nước ngoài hoạt động tại VN theo đúng các quy định của luật pháp quốc tế, trong đó có Công ước Vienna về quan hệ ngoại giao năm 1961. Đồng thời, các cơ quan đại diện ngoại giao và các nhà ngoại giao nước ngoài cũng có nghĩa vụ tuân thủ Công ước Vienna và tôn  trọng luật pháp của nước sở tại.
